Ogden, UT Debt Defense: Stop Creditor Harassment

Ogden, UT Debt Defense: Stop Creditor Harassment

Learn about Debt Defense in Ogden, UT. Old and long-forgotten debts, unfortunately, turn up at the most unexpected time. You fret and worry; think up ways on how to pay these debts back. You do not need a nasty debt collector who seems to be lurking and looking over your shoulder every single time. They can really be a nuisance, to say the least. Can we make them stop?

Debt Defense, Ogden, UT — Fair Debt Collection Practices Act (FDCPA): Protection for the Consumers

The FDCPA protects consumer rights against harassment from debt collectors and controls the communication between them. It also sets options to address or dispute debts.

Debt collectors are bound by rules and limitations on how they can collect. The following are just some of them.

A debt collector MUST:

  • Identify who they are and advise you that the communication is coming from a debt collector
    • They must also tell you that any information obtained is to be used for debt collection purposes
  • Send a written communication to your home address within five (5) days of the first communication with the following information:
    • Who they are
    • Who they are calling on behalf of
    • Why they are calling
    • Balance owed
    • They must also advise you that you have the right to dispute the debt and have thirty (30) days to demand that the said debt be validated
  • If you seek validation, the collector is to discontinue all attempts to collect until verification is provided
  • In obtaining a post-dated payment instrument, a written notice of the intent to deposit the post-dated instrument should be made

A debt collector legally CANNOT:

  • Call before 8 AM or after 9 PM or at any time they are given notice that it is inconvenient to call
  • Let known to other people i.e. family and friends (apart from your spouse) that a debt is owed
  • Call your place of employment or contact you through other communication technologies if they have been advised not to do so
  • Use any profane, harassing or abusive language
  • Engage in any conduct, the natural consequence of which is to harass, abuse or oppress
  • Make any misinterpretation of facts to force payment
  • Threaten arrest or criminal prosecution
  • Send false information to credit bureaus
  • Cause your telephone to ring an unreasonable amount of times

What can you benefit from the FDCPA?

  • You can make the collector stop getting in touch with you
  • You can recover actual damages suffered and/or statutory damage of up to $1,000.
  • You can be reimbursed for attorneys fees and court costs

Even with the above mentioned rules in place, it could still be daunting and intimidating to deal with these experienced debt collectors and the best way to stop the harassment is to hire a debt collection attorney who will act in your best interest in handling your debts.
